PAIA Manual
Access-to-information guidance for the Luthando Maduna Foundation under the Promotion of Access to Information Act, 2000 (PAIA).

1. Status and responsible body
This is a draft framework for a private-body manual under section 51 of PAIA, not a completed statutory manual. The Foundation’s registered address, head, registered Information Officer, designated deputies and official contact particulars must be verified and included before approval.
2. Understanding your right of access
PAIA enables access to records of a private body where the record is required for the exercise or protection of a right, subject to the Act’s requirements and grounds for refusal. Access is not automatic simply because a record is requested.
The Information Regulator publishes a guide to PAIA, prescribed forms and information about complaints. Consult the Information Regulator’s PAIA resources.
3. How to request a record
- Obtain the prescribed PAIA Form 2 from the Information Regulator.
- Identify the record, the right you seek to exercise or protect, and why the record is required.
- Provide your contact details, preferred form of access and proof of authority if acting for another person.
- Contact the Foundation below for the designated Information Officer and formal submission channel.
Do not send sensitive supporting documents until the Foundation confirms the appropriate submission process.
4. Fees, decisions and remedies
Prescribed request or access fees may apply, subject to statutory exemptions. Requests are generally decided within 30 days, with extensions only where permitted by PAIA. A refusal must be handled under the Act. Available remedies may include a complaint to the Information Regulator or an application to a competent court, subject to the relevant requirements and time limits.
5. Record categories and personal information
The approved manual must confirm records held under applicable legislation, records available without a formal request, and other record categories. Potential categories to verify include incorporation, governance, financial, membership, employment and service-provider records; this list is not a confirmed inventory.
The Foundation must also confirm its processing purposes, data-subject categories, recipients, planned cross-border transfers and information-security measures as required for its PAIA and POPIA disclosures.
6. Availability of the approved manual
The completed manual must state where it can be inspected and how copies can be obtained. Contact the Foundation for its current approved manual and official details.
